Migration Guide ("we", "us", "our") is committed to protecting your privacy. As an Australian Registered Migration Consultant practice, we handle highly sensitive personal information and treat it accordingly. This Privacy Policy explains what information we collect, why we collect it, how it is used and disclosed, and the choices you have. It applies to information collected through our website, by email, telephone, video conference, in person, and through our secure client portal.
This policy operates alongside our obligations under the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Migration Act 1958 (Cth), the Migration Agents Regulations 1998 (Cth), and the Code of Conduct for Registered Migration Agents.
01 Who we are
Migration Guide is a migration consultancy operating under the Office of the Migration Agents Registration Authority (OMARA). Our principal consultant holds Migration Agent Registration Number (MARN) 1805690. References to "Migration Guide" in this policy include our consultants, employees, contractors, and authorised representatives.
02 What is personal information?
"Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether it is recorded in material form or not. "Sensitive information" is a subset that includes information about health, race or ethnic origin, religion, sexual orientation, criminal record, and biometric data, and is afforded additional protection under the Privacy Act.
03 Information we collect
To advise on and lodge migration applications, we typically collect:
- Identity and contact information — full name, date and place of birth, passport details, residential and postal address, telephone numbers, email address, citizenship history, family composition.
- Migration history — previous Australian and overseas visa applications, grants, refusals, cancellations, travel history, immigration clearance details.
- Education, employment and skills — qualifications, transcripts, employment references, position descriptions, payroll evidence, English test results, skill assessment outcomes.
- Relationship and family evidence — marriage and birth certificates, joint financial records, declarations, photographs, communication evidence (for partner and family applications).
- Sensitive information — health and medical records, police clearances, military service records, religious affiliation (where relevant to a visa criterion), biometric data.
- Financial information — bank statements, tax returns, business records, evidence of funds, and details required for fee payment.
- Website data — IP address, browser type, device information, pages visited, referring URLs, and cookie data when you use this website (see Section 09).
04 How we collect information
We collect personal information directly from you wherever practicable — through consultations, intake forms, our client portal, email, telephone, and signed documents. In some cases we collect information from third parties with your consent or where authorised by law, including: skill assessing authorities; education providers; employers and sponsors; medical clinics and police authorities; the Department of Home Affairs; English test providers; and translators and notaries.
05 Purpose & how we use your information
We collect, hold, use and disclose your personal information for the following primary purposes:
- Providing migration assistance, advice, and representation
- Preparing, lodging, and managing visa, citizenship, sponsorship, nomination, and review applications
- Communicating with the Department of Home Affairs, OMARA, the Administrative Review Tribunal, and other government bodies on your behalf
- Verifying your identity, qualifications, and supporting documents
- Issuing fee disclosures, services agreements, invoices, and statements of services
- Maintaining the file records required by the Code of Conduct
- Complying with our legal, regulatory, and professional obligations
- Improving our services and website experience
06 Disclosure of personal information
We disclose personal information only when reasonably necessary for the purposes for which it was collected, or where required or authorised by law. Recipients may include:
- The Department of Home Affairs, OMARA, the Administrative Review Tribunal, and other Australian Government agencies
- Skill assessing authorities (such as Engineers Australia, ACS, VETASSESS, ANMAC, AHPRA, TRA)
- Employers, sponsors, nominators, and endorsing bodies
- Education providers and English test administrators
- Approved medical providers and police-clearance issuing authorities
- Lawyers, barristers, and counsel engaged in connection with your matter (with your consent)
- Translators, interpreters, and notaries
- Our IT, hosting, secure communication, accounting, and document-storage service providers
- Our professional indemnity insurer and legal advisors
- Courts, tribunals, or regulators where required by law
We do not sell or rent personal information to third parties for marketing purposes.
07 Overseas disclosure
Some of our service providers (including cloud-based document storage, secure messaging, and email infrastructure) may store data on servers located outside Australia. Where this occurs, we take reasonable steps to ensure that those providers handle personal information in a manner consistent with the Australian Privacy Principles. By engaging us, you consent to such disclosure, and you acknowledge that APP 8.1 may not apply.
08 Storage and security
We hold information in a combination of secure physical and electronic systems. Electronic records are stored in access-controlled, encrypted environments. Paper records are kept in locked storage. Access is restricted to personnel and contractors who require access in the course of providing migration services. We retain client files in accordance with the record-keeping requirements of the Code of Conduct (currently a minimum of seven years from the conclusion of the engagement) and our professional indemnity insurer's requirements.
While we take reasonable steps to protect your information, no method of electronic transmission or storage is completely secure. You are responsible for keeping the credentials you use to access our client portal confidential and for notifying us immediately of any suspected unauthorised access.
09 Cookies and website analytics
Our website uses cookies and similar technologies to remember your preferences, secure your client portal session, and understand how visitors use the site. You may disable cookies through your browser settings; doing so may affect the functionality of the client portal and some interactive features. We may use third-party analytics providers (for example, privacy-respecting visitor measurement tools) that collect aggregated, non-identifying website usage data.
10 Your rights — access and correction
You have the right to request access to the personal information we hold about you and to ask us to correct information you believe is inaccurate, out-of-date, incomplete, irrelevant, or misleading. To make a request, email info@miguide.com.au. We will respond within a reasonable period — usually within 30 days — and may need to verify your identity. There is generally no fee for a request, although in limited circumstances a reasonable charge may apply (we will advise you in advance).
11 Complaints
If you believe we have not handled your personal information in accordance with this policy or the Australian Privacy Principles, please contact us in writing at info@miguide.com.au setting out the nature of your concern. We will acknowledge your complaint within 7 business days and aim to resolve it within 30 days. If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner at oaic.gov.au.
Complaints relating to professional conduct of a Registered Migration Consultant may also be made to OMARA at mara.gov.au.
12 Code of Conduct obligations
In addition to the Privacy Act, we are bound by the Code of Conduct for Registered Migration Agents, which imposes strict obligations regarding the confidentiality, accuracy, and integrity of client information. Our handling of client information is governed by these obligations.
13 Children's privacy
We collect personal information about minors only in the context of a migration matter and only with the consent of a parent or legal guardian. We do not knowingly collect personal information from minors for any other purpose.
14 Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or in the law. The current version is always available on this page and the "Last updated" date will be revised accordingly. Material changes will be communicated to active clients by email.
