These Terms & Conditions ("Terms") govern your access to and use of the website published at miguide.com.au and any associated subdomains, application interfaces, or client portal services (collectively, the "Site") operated by Migration Guide ("we", "us", "our"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, you must not use the Site.
These Terms operate alongside our Privacy Policy and any separate written services agreement we enter into with you. In the event of inconsistency, the written services agreement prevails over these Terms.
01 About Migration Guide
Migration Guide is an Australian migration consultancy operating under the Office of the Migration Agents Registration Authority (OMARA). The principal consultant holds Migration Agent Registration Number (MARN) 1805690 and is bound by the Code of Conduct for Registered Migration Agents made under the Migration Act 1958 (Cth).
02 Acceptance & capacity
By using the Site you warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement, or that you are using the Site under the supervision of a parent or legal guardian who has accepted these Terms on your behalf.
03 Use of the Site
You may use the Site for lawful, non-commercial purposes only. You must not:
- Use the Site in a way that is unlawful, fraudulent, or harmful, or for any unlawful, fraudulent, or harmful purpose
- Attempt to gain unauthorised access to the Site, our systems, the client portal, or related infrastructure
- Reverse-engineer, decompile, or extract source code from any part of the Site
- Use any automated means (robots, scrapers, data-mining tools) to access or copy content from the Site without our written consent
- Transmit any virus, malware, or other malicious code through the Site
- Reproduce, republish, or commercialise content from the Site without our written consent (see Section 06)
04 Nature of information on the Site
Information published on the Site — including service overviews, news articles, FAQ content, and visa subclass summaries — is general in nature and provided for information purposes only. It is not migration advice, legal advice, or any form of professional recommendation tailored to your circumstances.
Migration law in Australia is complex and changes frequently. You must not rely on information published on the Site as a substitute for advice from a Registered Migration Consultant or legal practitioner. Outcomes in migration matters depend on individual circumstances, current law and policy, and decisions of statutory decision-makers.
05 No retainer until engagement
Browsing the Site, submitting a booking enquiry, or attending an initial consultation does not, by itself, create a client–consultant relationship. Migration Guide is engaged only when a written services agreement (the "Engagement Letter") has been signed by both parties and the agreed engagement fee has been paid.
Information you provide before an engagement is created (for example, through enquiry forms) is treated confidentially under our Privacy Policy and our Code of Conduct obligations, but it does not give rise to a retainer or any obligation on our part to act in your migration matter.
06 Intellectual property
All content on the Site — including text, graphics, logos, the Migration Guide name and mark, the MG monogram, page layouts, source code, and downloadable materials — is the property of Migration Guide or its licensors and is protected by Australian and international copyright, trade mark, and other intellectual property laws.
You may view, download, and print content from the Site solely for your own personal, non-commercial reference. Any other use — including reproduction, republication, modification, distribution, framing, mirroring, or commercial exploitation — requires our prior written consent.
07 Third-party links and resources
The Site contains links to third-party websites (including Department of Home Affairs, OMARA, the Federal Register of Legislation, and others) provided for convenience and reference. Migration Guide does not control these third-party websites, does not endorse their content, and is not responsible for their availability, accuracy, content, or privacy practices.
08 Client portal
Access to the Migration Guide client portal is restricted to current clients with whom we hold a signed Engagement Letter. You are responsible for keeping your portal credentials confidential and for all activity that occurs under your account. You must notify us immediately at info@miguide.com.au of any actual or suspected unauthorised access. We may suspend or terminate portal access at any time without notice where we reasonably suspect misuse, breach of these Terms, or a risk to the security of the portal.
09 Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, disclose, store, and protect personal information.
10 Disclaimers
Except as expressly provided in a written Engagement Letter, the Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we do not warrant that:
- The Site will be uninterrupted, error-free, or free of viruses or harmful components
- Information on the Site is accurate, complete, current, or fit for any particular purpose
- Any visa application or migration outcome will be granted or processed within any particular timeframe
Nothing in these Terms purports to exclude any consumer guarantee, condition, or warranty that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
11 Limitation of liability
To the maximum extent permitted by law, Migration Guide, its consultants, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, or exemplary loss or damage arising from or in connection with your use of, or inability to use, the Site, including loss of profits, loss of opportunity, loss of data, or loss of business, even if advised of the possibility of such loss.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Site is limited to the greater of: (a) AUD $100; or (b) the resupply of the relevant information or service.
12 Indemnity
You agree to indemnify and hold harmless Migration Guide and its consultants, employees, contractors, and agents from and against all claims, losses, damages, liabilities, costs, and expenses (including legal fees on a solicitor-client basis) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Site; or (c) any infringement by you of a third party's rights.
13 Code of Conduct
Where Migration Guide is engaged to act for you under a signed Engagement Letter, our conduct is governed by the Code of Conduct for Registered Migration Agents. The Code prevails over these Terms in respect of the consultant–client relationship.
14 Suspension and termination
We may suspend or restrict your access to the Site at any time, with or without notice, where we reasonably believe that your use breaches these Terms, exposes us or other users to risk, or is otherwise unlawful. Termination does not affect any rights or obligations that have accrued before termination.
15 Governing law and jurisdiction
These Terms are governed by the laws in force in the State of Victoria, Australia, and the Commonwealth of Australia. You and Migration Guide submit to the exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them in respect of any dispute arising from or in connection with these Terms or your use of the Site.
16 Severability and waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. A failure or delay by us to enforce a right under these Terms is not a waiver of that right.
17 Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page and the "Last updated" date will be revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
